Ohrid Guide is a city-discovery and tourism information app focused on Ohrid. The Service may include:

• information about places in Ohrid, such as churches, restaurants, nightlife, monuments, statues, cinemas, airports, indoor and outdoor sports locations, and other points of interest;
• map-based browsing and exploration;
• organized itineraries and tours with descriptions and schedules;
• nearby-place and distance functionality based on user location;
• favorites and account-based features;
• audio guides;
• push notifications; and
• links to external services for reviews, directions, or related actions.

3. Eligibility

You may use the Service only if you have legal capacity to enter into a binding agreement under applicable law. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and permission of a parent or legal guardian.

4. Accounts and Sign-In

Certain features, such as favorites or personalized functions, may require you to sign in using Google or Apple.

You agree that:

• the information associated with your account will be accurate and up to date;
• you are responsible for maintaining control of your sign-in method and device access;
• you are responsible for activity that occurs through your account, to the extent permitted by law; and
• you will notify us promptly if you believe your account has been used without authorization.

We may suspend, restrict, or terminate access to account-based features if we reasonably believe there has been misuse, fraud, unlawful activity, or a violation of these Terms.

5. Permissions and Device Features

The Service may request access to certain device functions, such as location services and notifications, in order to provide specific features.

You understand that:

• some features may not function properly without the necessary permissions;
• you may manage permissions through your device settings; and
• when you choose to open directions or external links, the request may be handled by your device’s default browser, map app, or another third-party service.

The Service is intended for general informational and convenience purposes.

While we aim to keep information helpful and reasonably up to date, we do not guarantee that all content is always complete, accurate, current, or available, including:

• place descriptions;
• opening hours;
• schedules;
• itinerary timing;
• route information;
• event information;
• ticketing or entry requirements;
• prices or fees;
• public reviews or ratings; or
• business availability.

Places, events, tours, hours, and routes may change without notice.

7. Itineraries, Tours, and Travel Planning

Any itinerary, day plan, or multi-day plan displayed in the Service is provided for planning and informational purposes only.

Unless expressly stated otherwise by us in writing, the Service does not create a booking, reservation, guided-tour contract, travel agency relationship, transport arrangement, or guarantee of access to any venue, attraction, event, or service provider.

You are solely responsible for:

• confirming availability, opening hours, pricing, and reservations;
• checking weather, transport, safety, accessibility, and local conditions;
• ensuring that you comply with local rules, venue rules, and applicable laws; and
• deciding whether any route, schedule, or location is suitable for you.

8. Third-Party Services, Reviews, and Links

The Service may display or link to third-party content and services, including:

• Google reviews and ratings;
• Google sign-in pages;
• Apple sign-in pages;
• browser-based review forms;
• external websites;
• OpenStreetMap-based map services; and
• default map or navigation apps.

We do not control third-party content or services and are not responsible for their availability, accuracy, legality, terms, privacy practices, or performance.

If you choose to leave a review for a place through Google or another third party, you do so directly with that provider, not with us.

9. License to Use the Service

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use.

You may not:

• copy, modify, distribute, sell, sublicense, rent, or commercially exploit the Service or its content;
• reverse engineer, decompile, or attempt to extract source code, except where such restriction is prohibited by law;
• remove proprietary notices;
• scrape or systematically extract data from the Service;
• use the Service to develop a competing product or service;
• interfere with the operation or security of the Service; or
• use the Service in any unlawful, harmful, fraudulent, or abusive manner.

10. Audio Guides and Intellectual Property

All content made available through the Service, including text, design, software, databases, graphics, audio guides, recordings, logos, layouts, maps as arranged within the app, and other materials, is owned by us or our licensors and is protected by applicable intellectual property laws.

Audio guides are licensed to you for personal, non-commercial listening only. You may not reproduce, distribute, publicly perform, resell, or otherwise exploit audio guide content without prior written permission from the rights holder.

11. User Conduct

You agree not to:

• misuse the Service;
• upload or transmit malicious code;
• attempt unauthorized access to the Service or related systems;
• impersonate another person or entity;
• use the Service for unlawful, defamatory, infringing, or misleading purposes;
• disrupt other users’ experience; or
• violate any applicable law, regulation, or third-party right.

12. Feedback

If you send us suggestions, feedback, ideas, or recommendations about the Service, you grant us a non-exclusive, worldwide, royalty-free, perpetual right to use and incorporate that feedback without compensation to you, unless applicable law requires otherwise.

13. Availability, Changes, and Maintenance

We may modify, suspend, discontinue, or update any part of the Service at any time, with or without notice, including features, place listings, itineraries, categories, or audio guides.

We do not guarantee that the Service will always be available, uninterrupted, error-free, or compatible with every device or operating system version.

14. Account Termination and Deletion

You may stop using the Service at any time.

If you have an account, you may request account deletion through the in-app settings. Users can delete their account directly within the application. The option is available in the Profile section after logging in.

We may suspend or terminate your access to the Service or any portion of it if:

• you violate these Terms;
• your use creates risk for us, other users, or third parties;
• we suspect fraud, abuse, or unlawful conduct; or
• we are required to do so by law.

Sections of these Terms that by their nature should survive termination will continue to apply after termination.

15. Disclaimers

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis.

We disclaim all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and uninterrupted operation.

Without limiting the above, we do not warrant that:

• the Service will always be available or error-free;
• any place, venue, event, or itinerary information will be accurate or current;
• third-party reviews, ratings, or map data will be correct;
• navigation or route information will be safe, complete, or suitable; or
• the Service will meet your expectations or requirements.

The Service is not an emergency service and must not be used as a substitute for emergency, medical, transport, legal, or safety advice.

16. Limitation of Liability

To the maximum extent permitted by law, HOPP SOLUTIONS DOOEL Ohrid, its affiliates, officers, employees, contractors, licensors, and partners shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, opportunities, travel plans, bookings, business, or reputation arising out of or related to your use of, or inability to use, the Service.

To the maximum extent permitted by law, our total aggregate liability for all claims arising out of or relating to the Service or these Terms shall not exceed the greater of:

• the amount you paid to us, if any, for the Service in the twelve (12) months preceding the event giving rise to the claim; or
• EUR 100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

17. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless HOPP SOLUTIONS DOOEL Ohrid and its affiliates, officers, employees, contractors, licensors, and partners from and against claims, liabilities, damages, losses, and expenses arising out of or related to:

• your misuse of the Service;
• your violation of these Terms;
• your violation of any applicable law; or
• your infringement of any third-party rights.

18. Governing Law and Jurisdiction

These Terms are governed by Laws of the Republic of North Macedonia, without regard to conflict of law rules.

Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of Competent courts in Ohrid, North Macedonia, unless mandatory consumer-protection law provides otherwise.

If you are a consumer, nothing in these Terms limits any mandatory rights you may have under applicable law.

19. Severability

If any provision of these Terms is held to be unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.

20. No Waiver

If we do not enforce a provision of these Terms, that does not mean we waive our right to enforce it later.

21. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last Updated” date above. Your continued use of the Service after the updated Terms take effect means you accept the revised Terms, to the extent permitted by law.
